The Legal Department of the UOC said it would appeal against the decision to transfer the Assumption Church in Kanev to the state

The Synodal Legal Department of the Ukrainian Orthodox Church has said that it is going to appeal against the court’s decision to return the Holy Dormition Cathedral of the UOC in the city of Kanev in Cherkasy Region to state ownership. This is reported on the official website of the UOC.

“In accordance with the prescriptions of Articles 241, 256 of the Economic Procedural Code of Ukraine, the decision of the economic court enters into legal force after the expiration of the period for filing an appeal, if an appeal has not been filed. An appeal against the court decision shall be filed within twenty days from the date of its proclamation. If only the opening and operative parts of the court decision were announced in the court session, or in the case of consideration of the case (resolution of the issue) without notifying (summoning) the participants of the case, the said term shall be calculated from the day of drawing up the full court decision”, – the Synodal Department says.

The Church’s lawyers add that they do not agree with the decision of the court of first instance and will file an appeal. In this regard, the Legal Department considers premature statements about the transfer of the Assumption Cathedral of the UOC in the city of Kanev to the state.

“As of today, the full text of the decision of the Commercial Court of Cherkassy region of 18.03.2024 in case No. 925/1107/23 has not been compiled, it has not been published on the official portals of the Judiciary of Ukraine, and the parties have not received it. Taking into account the fact that the relevant court decision has not entered into legal force, and the period for appeal has not expired, we inform about the prematurity of such publications and similar conclusions. Kyiv Metropolitanate of the Ukrainian Orthodox Church, not agreeing with the decision of the Economic Court of Cherkasy region, is preparing for the procedure of appeal”, – summarized in the Legal Department of the UOC.

We shall remind you that earlier it was reported that following the results of the lawsuit of Smelyansky District Prosecutor’s Office of Cherkasy region, the court obliged the Kyiv Metropolitanate of the UOC to return to state ownership the object of cultural heritage of national importance – Uspensky (St. George’s) Cathedral of the XIII century.
