Court obliges UOC to “return to the state” the Assumption Cathedral in Kanev

Following the results of a lawsuit filed by the Smelyanska district prosecutor’s office in Cherkasy Region, the court ordered the Kyiv Metropolitan Church of the Ukrainian Orthodox Church to return to state ownership the object of cultural heritage of national importance – the Uspensky (St. George’s) Cathedral of the XIII century. About it reports the website of the Office of the Prosecutor General.

“Assumption Cathedral – an ancient temple of the times of Kievan Rus, built in 1144 by Prince Vsevolod Olgovich. It was established that the executive committee of Kanevsky city council in 2003 granted permission to the Ukrainian Orthodox Church (MP) to formalize the ownership of the archaeological monument. Later it became the basis for the registration of the right of collective ownership. The prosecutors in court proved the illegality of the transfer of the building of the Assumption Cathedral. After all, the legislation establishes a direct prohibition of alienation of monuments of cultural heritage owned by the state. The court recognized illegal and canceled the decision of the executive Committee of the Kanev city Council, the certificate of ownership of the building for the UOC (MP), as well as canceled the state registration of the proprietary right to the object of cultural heritage of national importance”, – stated in the message.

We will remind, earlier we reported that on December 20, 2023 the Supreme Court of Ukraine canceled the decision of the Economic Court of Khmelnytsky region from June 29, 2023 on the eviction of the Mykolaiv religious community of the Ukrainian Orthodox Church in Kamyanets-Podolsky in Khmelnytsky region from the ancient Mykolaiv church and the transfer of the premises to the National Historical and Architectural Reserve “Kamyanets”.
