On July 22, the Vinnitsa Court of Appeal considered an appeal against the decision of the Vinnitsa City Court to close the proceedings in the case of the transfer of the religious community of the Transfiguration Cathedral of Vinnitsa to the OCU, reports the UOJ.
On November 27, 2019, the Vinnytsia City Court closed the proceedings in this case, arguing that “the courts are not authorized to resolve issues related to the change in the canonical subordination of a religious organization.”
At the hearing in the Vinnitsa Court of Appeal, the plaintiffs representing the interests of the UOC asked to send the case for consideration to the court of first instance, arguing that the claims put forward by the parties should be considered in civil proceedings and are not subject to the Economic Procedure Code.
Having heard the parties, the board of courts of the Vinnytsia Court of Appeal satisfied the appeal against the Transfiguration Cathedral and will send the case for a new consideration to the Vinnytsia City Court.
We will remind, on December 16, 2018 in the Holy Transfiguration Cathedral in Vinnitsa, the former Metropolitan of the UOC Vinnitsa and Barsky Simeon Shostatsky announced his transition and the transition of the community of the Transfiguration Cathedral to the OCU. Since then, courts have been going on between the UOC and the OCU.
