The head of the UOC-KP Filaret Denisenko and Channel 4 won the court at the suit of LGBT activists. Lawyer Taras Borovsky announced this on Facebook.
As stated in the published decision, “during the trial, it was not proved that the defendants committed an offense, which consisted precisely in the dissemination of information that, in accordance with the requirements of the law, could have the status of “unreliable”, violating personal moral rights, or damaging the relevant personal non-property , or prevents the plaintiff’s person from fully and timely exercising his personal non-property right”, since Filaret, answering a question from journalists,” expressed value judgments that cannot be refuted.”
“In addition, it should be noted that in accordance with the charter of the public organization Insight, it is not entitled to represent the interests of members of the public organization in courts. At the same time, in this case, it appears that the Public Organization “Insight” applied to the court not to defend its own violated right,” the court’s decision says.
Therefore, the lawsuit filed by the public organization Insight against Filaret and the Limited Liability Company TRK Interradio regarding the recognition of the information as unreliable, discriminatory and the obligation to refute it – the court refused in full.
